CBS FCC fine rescinded
PHILADELPHIA - A federal appeals court on Monday threw out a $550,000 indecency fine against CBS Corp. for the 2004 Super Bowl halftime show that ended with Janet Jackson's breast-baring "wardrobe malfunction."
The three-judge panel of the 3rd U.S. Circuit Court of Appeals ruled that the Federal Communications Commission "acted arbitrarily and capriciously" in issuing the fine for the fleeting image of nudity.
The 90 million people watching the Super Bowl, many of them children, heard Justin Timberlake sing, "Gonna have you naked by the end of this song," as he reached for Jackson's bustier.

K-fed gets custody
Los Angeles (E! Online) - Britney Spears has agreed to hand the parenting reins over to Kevin Federline.
K-Fed's longtime attorney, Mark Vincent Kaplan, exclusively tells E! News the divorced duo have reached a settlement in their long-gestating custody case.
According to the agreement signed by all parties, Federline gets sole legal and physical custody of sons Sean Preston and Jayden James and Spears will have visitation rights.
"The case has been settled," Kaplan said. "The court still has to approve it. " Both parties are due in court Friday morning.

Obituary
I hadn't heard anything on the Fourth of July holiday and that was strange. I had the urge to call the day before but since I have a history of being pushy, I let it go.
On the fifth, my birthday, it was my obligation to find out what was going on. It wasn't like Bill to not want to light firecrackers with little Billy on the holiday--it was a yearly debate.
I hoped he wasn't in jail. Illness had not crossed my mind. I thought he was the picture of good health but the things we think can be wrong.
Lauren's Birthday party June 14--the last time we were all together.
He was in the hospital.
William James McCloud III died July 15, 11 days after entering the hospital--after telling his wife Jennifer he wasn't feeling well.
Bill left work early that Wednesday, after consuming an energy drink. Apparently he was having a heart attack. His arteries were blocked.
Bill was only 38 years old. His birthday is next month and his mother tells me a big celebration had been planned.
Bill was my husband. He is the father of my two children. Even though we decided to live separate lives, we still cared for each other. We cared enough to let each other live in peace and stop the fighting. We got along because we wanted to.
Now, he is gone and I feel my former better half has left me alone. When in personal crisis, he was my go-to-guy.
Goodbye, Bill you are loved and I will make you proud and bring honor to your good name.

Death Row Records, the hip-hop label that released seminal gangster rap albums by Tupac Shakur, Dr. Dre and Snoop Dogg, has been auctioned for $24 million.
The New York-based Global Music Group Inc. said in a statement to The Associated Press on Monday that on June 24 it purchased Death Row, including its enviable back catalog and current artist contracts.
The purchase concluded the roller-coaster saga of one of hip-hop's most famous labels. Under owner Marion "Suge" Knight, Death Row sold tens of millions of albums in the heyday of early `90s rap — its artists often flashing the spoils of the high life in music videos — before collapsing in debt and mismanagement.
A former couple, Lydia and Michael Harris, claimed they helped found the label, and won a judgment of $107 million, which they tried to collect in 2006. Unable to pay, Death Row and Knight filed for bankruptcy in April 2006, claiming debts of more than $100 million.
In 2006, a federal judge ordered a bankruptcy trustee takeover of Death Row Records, saying the label had undergone gross mismanagement. Knight's decision to file for bankruptcy protection staved off a move by the court to appoint someone to take control of the record label and his assets.
Global Music Group, an independent label, takes ownership of albums including Dr. Dre's "The Chronic," Shakur's "All Eyez on Me" and Snoop Dogg's "Doggystyle."
Other assets are believed to include unreleased material from Shakur that could result in another posthumous release from the rapper.
Knight has a history of legal problems. He was convicted of assault in 1992 and placed on probation, then jailed for five years in 1996 for violating that probation.
He was returned to jail in 2003 for again violating parole, this time by punching a parking attendant at a Hollywood nightclub. He was released the next year.
In 2006 under questioning from his creditors, Knight denied having money tucked away in foreign countries. His bank account then contained just $11.
Global Music CEO Anthony Davi, Jr., said the label planned to get "the best economic results of the catalog and provide long term stewardship of the artists' work." The company plans to later announce details of its plans for Death Row.

Jay-Z saves Brit music festival with boost in tix sales
Jay-Z, flaunted his flag-flying American supremacy in front of an audience of thousands at last weekend's Glastonbury Festival in England.
So this year, when it was announced that American rapper Jay-Z would top the Glasto bill, Oasis's own mouthy mouthpiece Noel Gallagher was none too thrilled. Noel even went so far as to publicly blame Jigga for Glastonbury 2008's unusually low ticket sales.
Glastonbury is Britain's biggest summer rockfest, and it's usually headlined by popular limey rock bands like Coldplay, Muse, Radiohead, and Oasis.
"If it ain't broke, don't fix it. If you break it, people ain't gonna go," the famously cantankerous Britpopper complained to the BBC in one of his typically brazen interviews. "I'm sorry, but Jay-Z? No chance. I'm not having hip-hop at Glastonbury. No way. No. It's wrong."
Well, apparently 140,000 or so festivalgoers disagreed with Noel and showed up for the headlining Hova...who kicked off his Glastonbury set in a most cheeky fashion by performing Oasis's "Wonderwall" acoustic, dressed in a Gallagher-esque anorak, while a parody film featuring Noel's nasty comments screened behind him. The crowd exploded, according to The London Times, which reported: "Both audience and artist rose to the occasion and turned in a moment of real, euphoric, pop-culture history."
"[Jay-Z's] performance will go down in Glastonbury history," British paper The Independent also declared, while The Guardian concurred: "It's brilliantly staged, utterly thrilling, and it makes Gallagher look a bit of a berk."

Infected Sites in China affect Web
CAMBRIDGE, Mass. June 24-- The majority of the Internet's malware-infected websites are located on Chinese networks, finds a new report released today by StopBadware.org, the university-based research initiative aimed at protecting users from dangerous software. The report also identifies the 10 network blocks that contain the largest number of badware sites. Six of the 10 are located in China.
"Sites that infect visiting PCs represent some of the worst of digital pollution," said Jonathan Zittrain, StopBadware.org co-director and Professor of Law at Harvard Law School. "Malware is a global problem that requires cooperation across industries and across national borders."
As China strives to hone its image in preparation for the Beijing Olympics, 52 percent of the more than 200,000 infected sites StopBadware.org analyzed in late May were hosted by Chinese networks. U.S.-based networks accounted for 21 percent of bad sites. The data were provided by Google's Safe Browsing team and are searchable by URL in the StopBadware.org Badware Website Clearinghouse.
The analysis also revealed the Internet's 10 most infected network blocks:

Some directly control the infected servers on their networks, while others lease equipment and/or bandwidth to customers who control their own servers. Google, which is a sponsor of StopBadware.org, hosts free blogs on its network through its popular Blogger service. Malicious users sometimes exploit these free blogs as a means to link to or distribute malware. Google disables the blogs as soon as they detect the bad content, but the dead blogs remain in the list of infected sites until Google's automated malware detection system has an opportunity to rescan them.
Maxim Weinstein, manager of StopBadware.org, says the country and network data are a helpful step in understanding the distribution of malware, but we should be careful about assigning blame.
"Our goal in releasing this report is not to point fingers or to imply that network owners or governments are at fault for the malware on their networks, but rather to start a conversation. When different links in the Internet chain talk to each other and share information, it leads to solutions that in turn lead to a safer Internet for all of us."
He points, for example, to his team's success last year, when a similar StopBadware.org report revealed U.S.-based web hosting company iPowerWeb as home to over ten thousand infected sites, making it the most infected network at the time.
"When we published that report," says Weinstein, "it prompted iPowerWeb to ask for help. With support from StopBadware.org and data from Google, the company was able to clean up all those sites and secure its servers against future attacks." Weinstein notes that, based on the latest data, iPowerWeb is hosting so few infected sites that it is not even in the top 250 most infected networks.
On Friday, StopBadware.org researchers will present related research at the Workshop on the Economics of Information Security, hosted by the Tuck School of Business at Dartmouth College.

Lil' Wayne, Cash Money Records, riding high on record sales
NEW YORK - Lil Wayne now has official numbers to back up his bragging — the rapper's new CD has sold a spectacular 1 million copies its first week.
"Tha Carter III" is easily the best selling first week of the year, according to Nielsen SoundScan figures. Even Kanye West's "The Graduation" didn't eclipse that mark in its first week last year (though it was only about 50,000 copies short).

A Chicago jury has acquitted R. Kelly on all counts at his child pornography trial.
R. Kelly is accused of making a home sex video with an underage girl at his child pornography trial.

Ungrateful Actress?
Katherine Heigl, known as an actress who plays a doctor, on Grey's Anatomy and sometimes film actress (Knocked Up) said she doesn't want to be nominated for an Emmy because of bad "material."
It must be so nice to ride on a horse so high up in the air.
What is wrong with this woman? Is this a publicity stunt? Is it a swipe at her boss?
I would fire her if I were her boss.
The oh-so-high-on-her-horse actress said she also didn't want to stand in the way of anyone who got to act on a show with better "material." Whahh Whahh.
Grey's Anatomy is a highly rated show and a pretty good watch.
Creator and executive producer Shonda Rhimes should fire her ass for biting the hand that feeds her. She can be replaced. There are thousands of talented actresses who would love to stand in Heigl's shoes. Ingrate.

AMY WINEHOUSE’s incarcerated husband has been reportedly begging her to secretly fund his drug habit.
Blake Fielder-Civil, 25, is currently behind bars in London’s Pentonville Prison but is still tying to smuggle heroin into the establishment, reports British newspaper The Sun.
According to the publication, Fielder-Civil has asked the singer to make payments to another prisoner in a bid to fund his habit.
And Pentonville’s head of security Andy Watts is already suspicious of the plot.
He has written to Fielder-Civil’s solicitors, warning, "There is a strong and supported intelligence he is involved in attempting to smuggle drugs into the prison." Fielder-Civil has pleaded not guilty to charges of attempting to pervert the course of justice and will stand trial in June (08).
The 25-year-old is accused of attempting to fix the outcome of a previous trial for grievous bodily harm.

Road to the White House/WLTH voter registration/Response to attacks on Barack Obama
Where are the African American strategists now? How does Barack climb out of this one? African Americans who have been raised around other African Americans are probably just as surprised as I am at the violent reaction to Rev. Wright's sermons by certain members of the media.
It's as if they don't know any Blacks intimately. I remember as a cub reporter at the City News Bureau of Chicago, having to cover a newsstory at Trinity once and I think the news bureau editor expected me to come out of the church shocked and amazed at what I heard but I wasn't. It didn't help that I left out after getting quotes--it was a debate.
He probably thought I didn't hear it or stuck around long enough to hear it and that is why I wasn't alarmed. My co-worker wanted to know why I wasn't alarmed but we were so busy complaining about other stuff, that we drowned each other out. Now that I think about it, they probably figured my silence as agreement. Hmmmm.
Blacks everywhere are used to these remarks. Malcolm X said it. Dr. Martin Luther King Jr. said it to a degree--all of our (African American) leaders have touched on Rev. Wright's race-based subject matter in question. So What? Outside of the ridiculous ideas on 911 and AIDS and the government, the race-based sermons are reflective of the lives we (African American) live.
We live with terrible injustices and we mostly don't say or do anything so it feels good to have someone who understands our pain, like Rev. Wright. A lot of what was shown on TV was overboard. Many sermons are at least 45 minutes--anyone can drift in attention during that time. However, the points made on race are indicative of what most blacks encounter daily. Just think about what Rev. Wright encountered being older during the times of outright racism. It's too bad you non-blacks can't ask some of your black co-workers. (oh, I forgot--you don't have any IN THE EDITORIAL ROOM. WHERE ARE YOUR BLACK GATEKEEPERS?)
Even if you could find one and ask, he or she wouldn't be honest and tell you about it. You'd get upset--like many of you are now.
Blacks and Whites have a severely dysfunctional, abusive relationship where Whites seek to constantly dominate Blacks and other races by hook or crook. After a while, it's easier to get along and don't say anything and let people who aren't a minority think what they whilst. What I found is when I get past White anger (because they think I'm angry) we all get along swimmingly. So maybe it is the anger and hate that is the problem (Satan) and not race. Who can help what race they are? Anyways, put some African Americans in your NEWSROOM/EDITORIAL DEPT. (not the receptionist area) and watch how they cover news, who and what they are drawn to and how they characterize certain situations. Then, when something like this Rev. Wright situation comes up, you won't be surprised and angry. You'll already know.

Usher has No. 1 Song: "Love in this Club"

What kind of trouble can you get in for speaking up for your religion
This is my editorial response to this emerging debacle:
Why in the world would anyone censor these fine people for explaining Who gets them through their day? What happened to freedom of speech? These interviews were obviously taped while most--if not all of them were at work. They were supposed to be in uniform. Oh, so since the paper bills we use have "In God We Trust" on them, only Christians should use it? I think not. There are other things to attend to besides who worships and where and if they are representing the Government. Cut some slack, dudes.
